Pozi\u021bia autorit\u0103\u021bilor publice centrale este corect\u0103 doar la urm\u0103torul punctul: <em>\u201e\u00cen acest context, trebuie avute \u00een vedere prevederile art. 20 alin. 1 din Ordonan\u0163a de urgen\u0163\u0103 nr. 103\/2013 privind salarizarea personalului pl\u0103tit din fonduri publice \u00een anul 2014, precum \u015fi alte m\u0103suri \u00een domeniul cheltuielilor publice, cu modific\u0103rile \u0219i complet\u0103rile ulterioare, conform c\u0103rora \u201cFinan\u0163area sistemului de protec\u0163ie a copilului \u015fi a centrelor de asisten\u0163\u0103 social\u0103 a persoanelor cu handicap se asigur\u0103 de la bugetul de stat, din sume defalcate din taxa pe valoarea ad\u0103ugat\u0103, \u00een propor\u0163ie de cel mult 90% din necesarul stabilit anual de Ministerul Muncii, Familiei, Protec\u0163iei Sociale \u015fi Persoanelor V\u00e2rstnice, la elaborarea bugetului de stat, \u00een baza standardelor de cost calculate pentru beneficiari\/tipuri de servicii sociale, aprobate potrivit legii.\u201d <\/em>Pornind de la acest punct, ministerul de resort poate s\u0103 decid\u0103 \u00een mod arbitrar ce sum\u0103 aloc\u0103, ceea ce este recunoscut \u0219i \u00een pozi\u021bia prezentat\u0103 \u00een articol: pur \u0219i simplu nu intr\u0103 \u00een standardele de cost \u201echeltuieli indirecte cum ar fi cele aferente func\u021bion\u0103rii aparatului propriu al DGASPC, a c\u0103ror sus\u021binere financiar\u0103 trebuie asigurat\u0103 integral din bugetul jude\u021bului \u0219i nici cheltuieli de investi\u021bii.\u201d \u201eAdic\u0103, dac\u0103 avem un centru de plasament, cheltuielile legate de administrarea centrului, de \u00eenc\u0103lzirea, energie electric\u0103, contabilitate etc. nu intr\u0103 \u00een standarde de cost. Sau ce \u00eenseamn\u0103 concret func\u021bionarea aparatului propriu? Cine sunt asimila\u021bi categoriei aparatului propriu al DGASPC?\u201d,\u00a0 \u00eentreab\u0103 pre\u0219edintele Borboly Csaba, specific\u00e2nd c\u0103 textul de lege de mai sus prevede c\u0103 obliga\u021bia ministerului de resort este finan\u021barea p\u00e2n\u0103 la 90% a sistemului \u0219i nu a standardelor de cost, ace\u0219tia din urm\u0103 reprezent\u00e2nd doar o directiv\u0103 de calcul.<\/p>\n<p style=\"text-align: justify;\">Sumele efective:<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-2573\" src=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data1.jpg\" alt=\"data1\" width=\"605\" height=\"98\" srcset=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data1.jpg 605w, https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data1-300x49.jpg 300w\" sizes=\"(max-width: 605px) 100vw, 605px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">* sume virate p\u00e2n\u0103 \u00een 30 septembrie 2017<\/p>\n<p style=\"text-align: justify;\">Se vede clar, c\u0103 bugetul DGASPC Harghita p\u00e2n\u0103 \u00een 30 septembrie dep\u0103\u0219e\u0219te deja bugetul total pentru anul 2016, iar acest lucru se datoreaz\u0103 intr\u0103rii \u00een vigoare a Legii nr. 250\/2016 din 17 decembrie 2016, prin care au fost crescute salariile din sistemul de asisten\u021b\u0103 social\u0103 \u0219i protec\u021bia copiilor. Datorit\u0103 acestei legi, bugetul DGASPC Harghita aferent cheltuielilor de personal (f\u0103r\u0103 tot feluri de cheltuieli cum ar fi tichete de vacan\u021b\u0103 \u0219i etc. ) a crescut cu peste 60%, fa\u021b\u0103 de anul 2016.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-2574\" src=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data2.jpg\" alt=\"data2\" width=\"343\" height=\"61\" srcset=\"https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data2.jpg 343w, https:\/\/www.borbolycsaba.ro\/ro\/wp-content\/uploads\/2017\/10\/data2-300x53.jpg 300w\" sizes=\"(max-width: 343px) 100vw, 343px\" \/><\/a><\/p>\n<p style=\"text-align: justify;\">* sume p\u00e2n\u0103 30 septembrie 2017<\/p>\n<p style=\"text-align: justify;\">Practic, a fost impus\u0103 o cre\u0219tere a salariilor, dar \u00een acela\u0219i timp aloc\u0103rile bugetare aferente pentru \u00eendeplinirea obliga\u021biunii impuse nu au fost alocate.<\/p>\n<p style=\"text-align: justify;\">Revenind la afirma\u021bia c\u0103 standardele de cost \u201echeltuieli indirecte cum ar fi cele aferente func\u021bion\u0103rii aparatului propriu al DGASPC, a c\u0103ror sus\u021binere financiar\u0103 trebuie asigurat\u0103 integral din bugetul jude\u021bului \u0219i nici cheltuieli de investi\u021bii\u201d, Hot\u0103r\u00e2rea Guvernului nr. 978\/2015 privind aprobarea standardelor minime de cost pentru serviciile sociale \u015fi a nivelului venitului lunar pe membru de familie \u00een baza c\u0103reia se stabile\u015fte contribu\u0163ia lunar\u0103 de \u00eentre\u0163inere datorat\u0103 de c\u0103tre sus\u0163in\u0103torii legali ai persoanelor v\u00e2rstnice din centrele reziden\u0163iale, nu specific\u0103 ce intr\u0103 \u0219i ce nu intr\u0103 \u00een standarde de cost, ci specific\u0103 clar la art. 2: \u201e<em>Standardul minim de cost reprezint\u0103 costul minim aferent cheltuielilor anuale necesare furniz\u0103rii serviciilor sociale, calculat la nivel na\u0163ional pentru un beneficiar\/tip de serviciu social, potrivit standardelor minime de calitate \u00een vigoare pentru serviciul social respectiv\u201d.<\/em><\/p>\n<p style=\"text-align: justify;\">Adic\u0103 costul minim necesar furniz\u0103rii unui anumit tip de serviciu. \u0218i nu cheltuieli directe sau indirecte, c\u0103ci costul minim este determinat prin suma cheltuielilor directe \u0219i indirecte necesare asigur\u0103rii acelui tip de serviciu.<\/p>\n<p style=\"text-align: justify;\">Practic, prin aceste m\u0103suri, ministerul \u00eencearc\u0103 s\u0103 arunce \u00een responsabilitatea autorit\u0103\u021bilor locale tot mai multe cheltuieli, care \u00een mod normal reprezint\u0103 cheltuieli legate de asigurarea drepturilor constitu\u021bionale ale unor persoane dintr-o categorie special\u0103, care \u021bin de administra\u021bia public\u0103 central\u0103.<\/p>\n<p style=\"text-align: justify;\">\u201eDrept urmare, consider\u0103m c\u0103 nu se poate vorbi de o abordarea neprincipial\u0103 din partea noastr\u0103, \u00eenc\u00e2t nu Consiliul Jude\u021bean Harghita, \u0219i nici DGASPC Harghita nu stabilesc obliga\u021biile &#8211; inclusiv cele financiare &#8211; ale autorit\u0103\u021bilor fa\u021b\u0103 de serviciile sociale, ci Guvernul Rom\u00e2niei. Drept urmare intr\u0103 \u00een sarcina guvernului de a aloca resursele necesare \u00eendeplinirii acestor obliga\u021bii \u0219i respect\u0103rii drepturilor unei categorii de cet\u0103\u021beni ai Rom\u00e2niei.
